Terms of Service

General Terms and Conditions (GTC) for Falke Immobilien- und Beratungszentrum e.K.

1. Scope These General Terms and Conditions (GTC) apply to all business relationships between Falke Immobilien- und Beratungszentrum e.K., Küstersweg 20 c, 21079 Hamburg (hereinafter referred to as the "Broker"), and its customers (hereinafter referred to as the "Customer"). Deviating agreements require written confirmation.

2. Subject of the Contract The broker provides services in the field of real estate brokerage and construction financing. The broker brokers properties for sale or rent, as well as financing offers for real estate purchases.

3. Brokerage Agreement A brokerage agreement is concluded when a customer uses the broker's services, whether through a written or verbal order or through the use of exposés and offers from the broker.

4. Commission and Remuneration 4.1. The broker receives a commission for identifying or brokering a property, the amount of which is agreed upon individually. 4.2. The commission is due as soon as a purchase or rental agreement for the identified property has been legally concluded. 4.3. The obligation to pay the commission also applies if the purchase or rental agreement is concluded under different conditions or at a later date.

5. Broker's Obligations 5.1. The broker undertakes to carry out the assignments entrusted to him with the care of a prudent businessman. 5.2. The broker assumes no liability for the accuracy and completeness of information received from owners, authorities, or third parties.

6. Client's Obligations 6.1. The client is obligated to truthfully provide all information relevant to the conclusion of the contract. 6.2. The client is obligated to inform the broker immediately as soon as a purchase or rental agreement for a property identified by the broker is concluded. 6.3. The forwarding of broker offers to third parties without the broker's consent is not permitted.

7. Data Protection The broker processes the customer's personal data in accordance with current data protection regulations. Details can be found in the privacy policy.

8. Liability 8.1. The broker is not liable for the creditworthiness of contractual partners or for damages resulting from incorrect information provided by third parties. 8.2. The broker's liability for slightly negligent breaches of duty is excluded unless essential contractual obligations are affected.

9. Right of Withdrawal Consumers have the right to withdraw from a brokerage contract within 14 days without giving reasons. The withdrawal period begins upon conclusion of the contract. To exercise the right of withdrawal, the customer must notify the broker of their decision in writing.

10. Final Provisions 10.1. Amendments and additions to these General Terms and Conditions must be made in writing. 10.2. The place of jurisdiction for disputes is Hamburg. 10.3. Should any provision of these Terms and Conditions be invalid, the validity of the remaining provisions shall remain unaffected.
